Workers and employees are different, and they may have a different status.
Workers are now required to receive a statement of terms and conditions in accordance with the Employment Rights Act 1996 which has significantly increased the complexity of contracts put in place for zero hours workers.
This contract is for individuals engaged as zero-hours workers, where work is offered on a flexible, as-required basis. It is different from an employee contract because the Company is not obliged to provide regular or guaranteed work, and the Worker is not obliged to accept work when it is offered.
Each assignment is treated as a separate engagement, with no ongoing employment relationship between assignments. As a result, the Worker has worker status rather than employee status, meaning they have certain statutory rights, such as paid holiday, rest breaks and National Minimum Wage, but do not have the full range of employee rights and benefits that apply to employees.
